Jeffry S. Borow, President
Jeff has more than 30 years of experience in Life insurance and financial planning. Jeff is one of the nation's leading structured settlement consultants. Jeff's heavy financial planning background, combined with his insurance experience, greatly enhances his skills in negotiating structured settlements.
Martin Jacobson, Vice President and General Counsel
Marty is a licensed attorney in New York and New Jersey with extensive trial experience in both the state and federal courts. Prior to going into the private practice of law in 1976, he did defense work with the New York City Corporation Counsel's Office. Subsequently, Marty was a partner in a Wall Street area law firm in New York City. Marty is a renowned lecturer on structured settlements and periodic judgments and regularly presents seminars to the bench, bar association groups and law firms. Marty negotiates structured settlements for Creative Capital's clients and is an expert on the subject of periodic judgments, including CPLR Articles 50-A and 50-B.
Marty is also one of the nation’s leading authorities on settling wrongful imprisonment cases. CV
Dennis H. Waldman, Vice President, Secretary and Treasurer
In addition to his participation at mediation and settlement conferences, Dennis assists CCI’s attorney clients in achieving better settlements in a number of ways. Dennis is the CCI liaison to all of the life companies which underwrite structured settlement annuities, and is often the catalyst who can procure a better benefit for the plaintiff. Dennis handles some of Creative Capital's largest cases and routinely negotiates structured settlements at court conferences and in mediation.
Morris Lener, Vice President
Morris joined Creative Capital in February 1993. His credentials include a B.S. degree in business management and over seven years of supervisory accounting experience. Using his accounting, financial and computer skills for Creative Capital, Morris quickly grew to become a successful case negotiator and designer of sophisticated proposals and spreadsheets that are both informative and helpful in the settlement of cases.
Morris has developed a well-known and highly regarded expertise in the area of Periodic Judgments under New York Civil Practice Law and Rules Articles 50-A and 50-B. Using comprehensive worksheets and knowledge of CPLR Articles 50-A and 50-B, Morris has participated in numerous settlement conferences and seminars for clients throughout New York. In the area of wrongful imprisonment, Morris has assisted in the negotiation and settlement of some of the largest and most prominent cases.
Laurie B. Cohen, Senior Paralegal
Laurie joined Creative Capital in July, 1995. She graduated with a B.A. from the State University of New York at Albany in 1973 and pursued a Paralegal Certification in 1974. Laurie completed her Paralegal Certification from Adelphi University in 1974 and relocated to Boston, Massachusetts. While in Boston, Laurie was employed by the law firm of Hale & Dorr. In 1976, Laurie relocated back to New York and was employed by Cahill Gordon & Reindel, a large Wall Street firm.
In joining Creative Capital, Laurie brought a great deal of legal and work experience to enhance Creative Capital's team. Laurie, under the supervision of Martin Jacobson, Creative Capital's General Counsel, handles a case from beginning to end once a settlement is agreed upon. All settlement documents are prepared by her; she communicates with both plaintiff and defense attorneys until their differences are ironed out; she requests and handles premium submissions to the life companies; and liaises with the life companies to see the case to completion. Inquiries regarding matters after the annuity contract is issued are also handled by Laurie.
Charles Jacobson, Assistant Vice President
Charles joined Creative Capital in 2003. Charles meets regularly with attorneys and plaintiffs to explain structured settlements and to help them choose an appropriate plan. Charles also helps to resolve cases by attending meditation and settlement conferences. He also works with life insurance markets once a plan is chosen to ensure that the best benefit possible is obtained. A computer science graduate of GWU’s engineering school, he is also responsible for the creation, design and maintenance of CCI’s multiple in-use database packages including a MySQL back end and php web interface designed specifically for Creative Capital. He has had experience with Linux operating systems and setting up office environment networks.
Stefanie Jacobson Petit, Marketing Director
Stefanie joined Creative Capital in 2007. Stefanie is responsible for overseeing Creative Capital’s marketing, brand awareness and strategic relationships with regional and national partners. Stefanie received her Bachelors of Arts degree from Fairleigh Dickinson University and also holds a Masters in Graphic Communication Management from New York University.
Stefanie is “the public face” of Creative Capital keeping the company current, tech savvy, and appealing to CCI’s trial lawyer clients. As our liaison to trial lawyer associations (e.g. AAJ, NYSTLA, CTLA, NJAJ, NYS Academy, etc.) Stefanie helps direct CCI’s ongoing educational effort to inform our attorney clients of the resources available to them, without charge, from the CCI Team.
Rhys Andersen, Structured Settlement Associate
Rhys joined Creative Capital in 2015. Rhys began with CCI on a part-time basis assisting its back office in a variety of roles. Rhys now works with Jeff Borow, Morris Lener and Charles Jacobson assisting our clients, working to help plaintiffs and attorneys in choosing an appropriate structured settlement design. Rhys also works with the life insurance markets to provide the best possible benefit once a settlement plan has been chosen. With a background in analyzing expenses, business models, and investments, Rhys takes pride in supporting CCI’s clients through crafting structure settlements and attending mediation and settlement conferences.
Lana O'Brien, Associate General Counsel
Lana joined Creative Capital in 2018. She graduated from Vassar College and received her law degree from New York University School of Law. While at NYU, Lana served as an Article and Note and Staff Editor on the Journal of Legislation and Public Policy and participated in the Civil Rights Clinic. After graduating from law school, Lana practiced corporate litigation at Simpson Thacher & Bartlett. She represented clients on large-scale antitrust, securities and insurance matters, while also working pro bono to obtain asylum on behalf of a Tibetan refugee.
Happy to bring her legal skills to CCI, Lana works closely with General Counsel Marty Jacobson to advise clients on the tax and legal consequences driving structured settlements. Lana and the rest of the legal team see cases through from start to finish, answering questions that arise throughout the process. Lana is admitted to practice law in New York and New Jersey.
Creative Capital Regional Offices
Richard Goldstein, Manlius, New York was a successful John Hancock Life Insurance Agent and Financial Planner in Hancock's Syracuse, New York office prior to joining the Creative Capital team as its Upstate and Western New York representative in 1983. He has been with Creative Capital since that time and has over 30 years of structured settlement experience, all of which is concentrated in New York State. His extensive experience and skills in structured settlements include areas such as creative quote design, negotiation and mediation. In addition to his extensive experience in the general structured settlement area, Rich has developed a strong specialization in New York State's Periodic Judgment Statutes under CPLR Articles 50-A and 50-B. Rich has been very successful in handling some of Creative Capital's major accounts in the Upstate New York region. Acting for and in conjunction with the Assistant Attorney General staff of the New York State Department of Law - Attorney General's Office, Rich has handled some of New York State's largest claims. He is well known by many of the Upstate New York judges and is regularly referred to as "Doctor Goldstein" by some of them because of his reputation as a true specialist knowledgeable in the complexities of CPLR Articles 50-A and 50-B.
Gary McMickle, Grapevine, Texas - Gary McMickle, over the past 40 years, has been involved in over $3Billion in personal injury settlements. He has been active in creating and negotiating settlements involving structured settlements since the mid 1970's.
Gary has personally placed in excess of $450Million in structured settlement annuity premium. He has extensive experience in evaluating life care plans for quadriplegic, paraplegic and brain damage cases. He has testified as an expert witness on numerous occasions.
Mr. McMickle anchors the Creative Capital office in Dallas/Ft. Worth, Texas, which he originated in 1992. Prior to joining Creative Capital he operated the Dallas/Ft. Worth office for Ringler Associates which he opened in 1984. From 1977-84 Mr. McMickle was Assistant Vice President of Claims for Scor Reinsurance Company in their home office in Dallas. From 1974-77, he worked in the home office for Foremost Insurance Company in Grand Rapids, Michigan where he was Divisional Claims Superintendent of Surplus Lines Claims. Mr. McMickle started his career in 1968 with Liberty Mutual Insurance, working in East Orange & Saddle Brook, New Jersey; Kansas City & St. Louis, Missouri; and Detroit, Michigan. A graduate of the College of Emporia in 1968, Gary holds a Bachelor of Arts degree in Business Administration.
Max Wernick and Ken Wernick, New City, New York are a father and son team within the Creative Capital organization. Max Wernick, Regional Vice President, was employed by Cosmopolitan Mutual Insurance Company from June, 1961 until May, 1976 as an examiner, claims manager and officer of the claims and legal departments of the company. In that capacity Max handled thousands of claims in his fifteen years with Cosmo. He also developed a reputation as a tough but fair negotiator with plaintiff attorneys, some of whom have developed into today's "heavy hitters". These attorneys know and respect his capabilities and the fact that he will not give away the store when acting for the defense. At Cosmo, Max handled auto, GL, construction and almost every type of claim except medical malpractice. In 1976, he joined a P&C brokerage firm with a life division and worked in the financial services arena specializing in financial and estate planning. In 1981, he founded his own structured settlement company, Max Wernick Associates Inc., which merged into Creative Capital Inc. in 1989. Max is one of Creative Capital's most seasoned professionals and is well known in claims and defense circles and among the plaintiffs' bar.
Roger Roggenbaum, CSSC, entered the structured settlement consulting field in 1995 following a successful 20+ year career in senior claims management positions. He has developed and enjoyed long-term established relationships, which he and Creative Capital largely attribute to Roger's commitment to deliver hands-on, personalized services tailored to each client's individual expectations.
Over the years, many trial lawyers have requested Roger's services because of his expertise, integrity and objective analyses and presentations. A prominent Trial attorney in Wilkes-Barre, Pennsylvania, Joseph A. Quinn, Jr. of Hourigan, Kluger & Quinn, P.C, commented, "I have known Roger for many years and have used his services in multiple cases.
