Certificate of Reliability and Assurances
Creative Capital Inc. is the only structured settlement firm that offers protection
from fraud and misrepresentation through a Certificate of Reliability and Assurances
(CORA). Made under oath, this affidavit asserts the integrity of the settlement
process, assures the full disclosure of terms, and carries all penalties for perjury.
Abuse of the System
Despite legal and regulatory prohibitions to prevent rebating, it is common
knowledge that existing laws are frequently ignored as some structured settlement
brokers pay part of their commission to their casualty insurer clients. Although
tied to a percentage of commissions earned by the broker, such arrangements
have been called "service fees" or "administrative fees".
CCI's stated position, along with legal departments of life insurance companies,
is that these are transparent attempts to avoid anti-rebating laws on the books
in most states.
CCI's Practice
CORA is a series of affirmative representations and warranties issued in writing
for every case. These certify that CCI:
- Does not pay commission rebates to any party or insurer, or evade the anti-rebating
statutes through "service fee" or "administrative fee"
arrangements
- Fully discloses age ratings and never misrepresents the cost of a structured
settlement by engaging in post settlement medical underwriting
- Always discloses the true cost of the structured settlements it negotiates
and does not attempt to artificially inflate the value of any settlement by
using unrealistic present value calculations
- Is not an "in house" or captive broker owned or controlled by
an insurance carrier
Insist on CORA
CCI has continually taken the lead in advocating ethical and professional standards
in the structured settlement industry. Plaintiffs, defendants and the courts
can rest assured that the facts and the numbers are indeed as they are represented
when CCI handles a case. CORA's warranty section would expose CCI to civil and
criminal liability if any statement were false. No other structured settlement
firm offers anything like it.
